This contract is just so that you get a chance to read and address any questions you might have about our policies.

PURCHASE AGREEMENT
This contract between the original breeder and buyer and is non-transferable. All puppies are sold as pets only, LIMITED AKC, not for breeding purposes. It is agreed that the puppy will be spayed or neutered by age of 12 months. The breeder does not guarantee size or color of puppy. The breeder is released from all expenses after the transfer of this puppy and all expenses are the sole responsibility of the buyer. In the event that the buyer cannot keep the puppy, the puppy must be returned to the breeder with all paperwork and the buyer must sign an agreement to release all right to this puppy (no money will be refunded).
LIMITED 1 YEAR PUPPY WARRANTY
The breeder warranties this puppy to be in good health at the transfer of ownership to the buyer and for 1 year from the date of purchase against hereditary and congenital disorders that may interfere with this puppies ability to lead a normal life. This warranty is void unless a licensed veterinarian examines this puppy within four days from the date of transfer. During the initial exam, should your veterinarian diagnose any physical health problem that will require further veterinarian care, other than required vaccinations and/or worming buyer must notify the seller within twenty-four hours. The puppy will be replaced with another puppy of equal value when more puppies are available. The puppy must be returned to the breeder with a written report by a licensed veterinarian, including original paperwork provided at the time the puppy was purchased, within four business days of a licensed veterinarian's diagnosis.
If the puppy is diagnosed with a congenital or hereditary defect during the first year from the date of purchase the puppy must be returned to seller within four days of examination with all the documentation from a licensed veterinarian to be replaced with another puppy of equal value when one becomes available (no money will be refunded). The warranty is void if any/all documentation is not delivered to the breeder as requested within 4 days of diagnosis. Should the buyer wish to keep this puppy, no replacement puppy will be given, and medical treatments and cost are the sole responsibility of the buyer.
If the puppy dies within 1-year from the date of transfer (not including preventable illnesses or accidents) buyer must notify the breeder within 24 hours, have followed all advice by a licensed vet, have an autopsy performed by a state lab and provide seller with copies of all reports including original paperwork provided at the time this puppy was purchased. This puppy will be replaced with another puppy of equal value at the buyer’s convenience and choice (no money will be refunded).
Our warranty does not cover fleas, ticks, mites, worms, heartworms, coccidia, corona, distemper, giardia, hepatitis, parvo, and leptospirosis as well as any/all reactions to vaccines or heartworm, flea and tick preventative. Our warranty will be voided if shot schedule is not followed and this puppy is taken out in public areas before 2 weeks after 3rd and final vaccines. This puppy has received his/her first puppy shot before going home unless otherwise noted in this contract. We do not give the Lepto shot and recommend that you follow your veterinarian guidelines for the Lepto shot if needed.

_______1. I understand that this contract & 1-year warranty begins the date of transference of this puppy, is

_______2. I understand that this puppy is sold under a “Limited AKC Registration” meaning that the dog is
AKC registered but no litters produced by this dog are eligible for AKC registration and this is not a
sanctioned breeding dog. I agree that this puppy is sold as pet only and shall be spayed/neutered by
12 months of age.
_______3. I understand that at transference the breeder is no longer responsible for this puppy and the sole
responsibility/expenses of this puppy becomes the buyer's responsibility.
_______4. I understand that if for any reason that I can no longer keep this puppy it will be returned to the
original breeder with any/all original paperwork, AKC registration papers and all medical records
(no money will be refunded).
_______5. I understand that this puppy is in good health at transference and I must take puppy to licensed
veterinarian for an examination within 30 days of transference or warranty is automatically voided.
_______6. I have read & understand as described in detail on page 1 of this contract & warranty that upon
hereditary/congenital defects or death within the first year as the the warranty states that the buyer
will have choice of a puppy for same value and that no money will be refunded. Warranty is void
if requested paperwork does not accompany and is not returned to seller within 4 days of diagnosis.

replacement puppy will be given, and medical treatments/cost are sole responsibility of the buyer.

regular veterinarian immediately. I understand taking the puppy out in public before minimum of
2 weeks after 3rd and final shots are given voids the warranty.
______10. The Buyer agrees that he/she understands this contract fully, and that this contract is under the jurisdiction
of the State of Texas; in Dallas County. It is agreed the place of venue shall be in Dallas County, TX.
In the event the buyer pursues legal action against breeder, buyer agrees to pay any/all fees incurred by
the breeder should the court find in favor of the breeder.

AKC Foundation:
Our guide for the welfare, improvement and advancement of the Havanese breed is in accordance with the Standard, as approved by the American Kennel Club and based on the written records of breeders who were involved breeding Havanese when they first came to the states. We breed AKC Havanese ONLY.
Care:
Our Havanese live in our homes, receive excellent veterinary care, premium nutrition and regular grooming. We do not house our dogs outside of our homes in kennels, dog houses, etc.
Honesty Clause:
We strive to provide truth in advertising, information, and sales through education.
Breeding:
Every breeding will be done from the standpoint of bettering the breed. We make no guarantees to size, color or show quality although, we do breed for temperament, conformation, excellence and breed standard. Our adult dogs are OFA tested. Our dogs are seen by our outstanding veterinarian group whom we have been going to for years. We do not breed any dog until they are both physically and mentally mature. We do not continue to breed any dog beyond an appropriate age for the breed which is about eight years or earlier.
Records:
We keep complete and accurate records of individual dogs, litters, breeding, pedigree and puppy sales as required by the American Kennel Club. AKC has seen our records and we proudly have certifications of an excellent examinations.
Registration:
The breeder will provide the AKC application for registration at the time of sale or at the time of spaying or neutering confirmation by a licensed veterinarian. We sell puppies with Limited Registration (no breeding). Full Registration (breeding) is on a case by case basis and has an additional fee.
Our “Puppy People”:
We offer a ‘Meet and Greet’ for people to meet our adult Havanese to find out if this breed is a good fit for their lifestyle. Our puppies are precious but the buyer will spend the majority of time with an adult dog. We look for the right fit for our puppies. We hold the option to refuse sale to anyone. We have a ‘Havanese Day’ annually to visit with previous buyers and their Havanese.
Time of Sale:
We guarantee a healthy puppy with a limited 1 year warranty. Our puppies have had their dewclaws removed, they have been microchipped, and received their first puppy shots. Our puppies are seen by our veterinarian twice before they go home. They are naturally weaned by their mothers. We send home a toy that smells of Mom and siblings with a bag of dog food. We go over all of the information with the new buyer when they pick up their puppy. We provide a notebook with instruction on feeding, care, training and grooming, and medical records including dates and types of vaccinations, etc. We strongly discourage taking a puppy into public until 2 weeks after it has had its’ final puppy shots. We offer several ways to continue to socialize their puppy.
Contracts:
Contracts are clear, complete and mandatory. All conditions are agreed upon between buyer and seller as written. Our contract states that the breeder/seller be notified if the owner is unable to keep the Havanese. If the buyer can no longer keep a havanese purchased from 2 Cute our contract requires it to be returned, regardless of the reason or circumstances necessitating its return. There is no refund. Please read and understand our contract on this website prior to purchase.

Testing Guidelines
When we began 2 Cute Havanese we wanted to always have the healthiest of puppies possible. To have healthy puppies requires healthy adult dogs. We needed to qualify “Healthy” and to the best of their ability OFA looks at each breed and provides testing recommendations specifically for that breed. News in genetic testing is exploding. Is there a plethora or bounty of tests available to cover all the bases from A to Z? No, not at this time but there are some DNA tests available. It is a growing field.
Why Orthopedic Foundation for Animals (OFA)? What is OFA?
For over 50 years OFA has strived and grown to improve the overall breeding health of animals via testing, collecting data, assimilation, and informative management of tests results.
“Our mission is to promote the health and welfare of companion animals through a reduction in the incidence of genetic disease.”
“The CHIC (Canine Health Information Center) database is a tool that collects health information on individual animals from multiple sources. This centralized pool of data is maintained to assist breeders in making more informed breeding choices, and for scientists in conducting research. The CHIC program is breed-specific. Test results are submitted for certificates. If not flaw free then the flaw and degree is determined and recorded on each certificate with any breeding recommendations. If all breed tests are turned in, then, the owner will be sent a CHIC certificate.
OFA Test Recommendations for Havanese
BAER - A test for deafness with specialized equipment given by a qualified DVM.
CAER - A canine ophthalmologist screens for hereditary eye abnormalities and diseases. Previously this was called CERF.
Patellar Luxation (Patella or Kneecap in rear legs) - A DVM gives a physical examination of the patella to check if the kneecap pops
or slides out of normal position.
Canine Hip Dysplasia (CHD) - A DVM gives a physical examination and takes an x-ray of the hips to check for a proper joint fit.
Heart - Not an OFA test suggestion for Havanese but our DVMs check for irregularities because we care.
2 Cute Havanese DNA Testing
CDDY – Chondrodystrophy is an avoidable mutation that can be identified through genetic testing at UC Davis VGL. CDPA - Chondrodysplasia, was CD now known as CDPA, in the article "Breed Defining Chondrodysplasia" by Julia Bouirmane in My Dog DNA explains CDPA is a "desirable trait". CDPA is a characteristic found in many breeds such as French Bulldogs, Corgis or Shih Tzu and others. It is part of what is grouped as a "breed defining," positive trait. Diversity – A genome-wide DNA test to identify the level of diversification or inbreeding in a subject. Deducing the Coefficient of Inbreeding or COI (0% -25% and higher) allows the breeder to choose the best pairings from his/her kennel. The lower percentage indicates fewer blood relations. Lack of DNA diversity is a very serious issue for several breeds including Havanese. There is more to breeding such as temperament, conformation, etc. |
